KROQ BRACKETS GAME
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED
1. HOW TO ENTER

a. Contest starts immediately after the names of the teams participating in the Division 1 College Basketball Championships are announced and ends on April 6th 2005.

b. To enter the KROQ Brackets Game contest, participants must go www.kroq.com and complete the online entry form with your first name and last name, complete address, city, state, zip code, home telephone number, and a valid e-mail address. Only one (1) entry per person or e-mail address. More than one (1) entry from any person or e-mail address will void all entries from that person or e-mail address unless duplicate entries are made to correct an official change as described in Section 4b. KROQ is not responsible for entries not received due to difficulty accessing the Internet, service outages or delays, computer difficulties and other technological glitches. All entries become the sole property of KROQ. Entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization that is responsible for assigning e-mail addresses or the domain associated with the submitted e-mail address. For purposes of these Official Rules, “receipt” of any online entry will be solely determined when the contest Administrator’s website server records the entry data. Any automated computer form reply or receipt (such as one confirming delivery of email) does not constitute actual receipt by Administrator of an entry form for purposes of these Official Rules. KROQ may request proof that any potential winner is the authorized account holder of the e-mail address associated with any potential winning entry.

c. The deadline for submitting entries is one (1) hour prior to the start of the first game on March 17, 2005.

d. Your legal name must be entered on the entry form, as proof of identity is necessary to claim any prize. Use of automated devices is not valid for entry.

2. ELIGIBILITY

a. The promotion is open to all legal residents of the State of California who are 18 year of age or older and are currently residing in the State of California. Employees of Infinity Broadcasting Corporation of Los Angeles, KROQ-FM, its parent corporation Viacom Inc., any participating sponsors, affiliates, subsidiaries, its advertising agencies, promotion partners, any other Los Angeles market radio stations, their immediate families (defined as spouse, child, sibling, parent, or grandparent) and those living in the same household are NOT eligible to participate or win.

b. Anyone who has won a prize from KROQ in the last 30 days or their immediate families (defined as spouse, child, sibling, parent, or grandparent) and those living in the same household are NOT eligible to participate.

c. Only one (1) winner per household is permitted in any contest.

d. Participants are required to provide truthful information and KROQ will reject and delete any entry that it discovers to be false or fraudulent. KROQ will also disqualify any entry received from persons under the minimum age specified for this contest and will also delete the entries received from any person under the age of 13 in compliance with the Children’s Online Privacy Protection Act.

3. PRIZES
a. One (1) Grand Prize Winner shall be awarded a large screen television with an approximate retail value of $500. If for any reason this prize is unavailable KROQ reserves the right to substitute said prize for another prize of equal or higher value.
b. All prizes or prize certificates may be picked up at the office of KROQ at 5901 Venice Blvd.; Los Angeles, CA 90034. The Winner will forfeit any prize not claimed within forty-five (45) days of winning. In the event that a prize or prize certificate is mailed to the winner, it will be with the prior written consent of the winner and therefore, winner assumes the risk of its loss. KROQ is not responsible for the safe arrival of a prize or prize certificate.
c. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses. Other restrictions may apply.


4. WINNER SELECTION AND NOTIFICATION

a. Decisions of KROQ management with respect to the contest are final.

b. Participants must complete the entry form by predicting the outcome of each of the 64 games in the 2005 Division 1 college basketball tournament and the total final score of the tournament’s Championship Game. In the event that the teams participating in a game changes once your entry is submitted, it is your responsibility to modify your entry accordingly by submitting a new entry. Your last entry that we receive before the deadline will be the only entry we shall consider as valid. Each correct prediction, not including the total score of the Championship Game will be given the corresponding points:
1st round (Field of 64) - 1 point
2nd round (Field of 32) - 2 points
3rd round (Field of 16) - 3 points
4th round (Field of 8) - 4 points
5th round (Field of 4) - 5 points
6th round (Championship Game) - 10 points
The maximum score achievable is 124 points.
c. Ties shall be broken as follows: In the event of any tie, the top 3 players will be broken down until there is a single contestant for each spot in the following order until no ties remain:
1. The winner of the 1st tie-breaker will be the person who guess is closest to the total points of the Championship game;
2. If necessary, the winner of the second tie-breaker will be the person whose guess is closest to the total points without going over.
3. If necessary, the winner of the 3rd tie-breaker will be person that submitted their final picks earliest. If a tie still remains, a random drawing shall be conducted by us to break the tie.
4. The losing party to any tiebreaker will move down one position in the rankings.

d. The winner/s shall be determined after the completion of the Championship Game, scheduled to be played on April 4, 2005. Awarding of prizes is subject to validation and eligibility verification.

e. Winners will be notified by telephone within seven working days after April 6th 2005. If KROQ is unable to contact winner via telephone within 14 working days prize will be forfeit and the alternative winner will be selected.

f. Odds of winning depend on the number of eligible entries received.


5. CONDITIONS

a. Payments of all federal, state and local taxes are solely the responsibility of the winners. Winners may be required to sign an IRS Form W-9 or the equivalent.

b. By participating in the contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.

c. By entering the promotion or participating in any promotion or prize-related activity, participants agree to release, discharge, and hold harmless KROQ, their participating sponsors, affiliates, subsidiaries and their respective officers, directors, employees, and agents from any injury loss or damages of any kind that may arise out of participation in this promotion or out of acceptance, use, misuse, or possession of prizes. By participating, you agree to use these Official Rules and the decisions of the judges (KROQ), which are final and binding in all respects.

d. KROQ reserves the right in its sole discretion to cancel, modify, suspend, or terminate the promotion. KROQ is not responsible for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications, line failure, theft or destruction, or unauthorized access to or alteration of entries.

e. KROQ reserves the right to make changes in the rules of the contest, including the substitution of a prize of equivalent value, which will become effective upon announcement

f. Failure to comply with the contest rules may result in a contestant’s disqualification solely at the discretion of KROQ.

g. KROQ is not responsible for typographical or other errors in the printing, the offering or the administration of the contest, or in the announcement of a prize.

h. Copies of the written contest rules and a list of winners (when complete) are available during regular business hours at the main studio of KROQ by , or by sending a self-addressed stamped envelope to: KROQ-FM P.O. Box 10670 Burbank, CA 91510.

6. INTERNET SWEEPSTAKES PRIVACY POLICY

a. By use of this website and by entering the Contest, you agree to KROQ Web Site Terms of Use Agreement and to the use of your personal information as described in the Privacy Policy located at: www.kroq.com.
